By using our site you agree to the following terms & conditions. Please read them carefully.
All information contained on our website is believed to be accurate and reliable at the time of publishing. Errors such as misprints or omissions are excepted. We reserve the right to make changes and corrections anytime in prices, products and specifications without notice. If we have made an obvious error in pricing (i.e. an item price is $0.00) we reserve the right to cancel the order.
From time to time we may need to confirm your details. If this is the case we will contact you by telephone or email. If we are unable to establish contact & you do not reply to our email/voicemail/text message within 3 days we reserve the right to cancel your order.
We reserve the right to refuse or cancel any orders, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will immediately issue a credit to your credit card. We will inform you as soon as possible cancellation of orders.
We ship to the USA, New Zealand, the UK & all other countries where Australia Post provides full tracking & signature at final destination. All international orders must be paid for by PayPal.
To deter credit card fraud when you confirm your order, your IP address will be logged.
In no circumstances are we liable for special, indirect or consequential loss or damage of any kind including any loss of profit or of contract, even if you advise us of any special circumstances or such loss was reasonably foreseeable. This includes, but is not limited to, the transmission of any computer viruses or anything else that may interfere with or damage the operation of your computer system.
Products may vary in appearance due to manufacturers altering their packaging. Therefore, images are for illustration purposes only. Manufacturers change the specifications from time to time. It's not always possible to change these specifications as soon as they come to light & Bay Park Photos will not be held liable for these changes.
Please specify in the notes of your order if you do not wish to be added to our newsletters containing tips and techniques for your photography. Please know that you can unsubscribe from our mailing list at any time.
In-store Pick up.
Payment can be taken in store at the time you collect your items or online at time of order. Photo ID will be required when picking up items in store. Payments made by credit card will require presentation of the credit card in store to collect goods. You will also be required to present your tax invoice & paypal receipt (if paid for by PayPal)
We accept Mastercard, Visa, American Express, PayPal, cash & direct deposit. We do not charge a surcharge for any payments made by the aforementioned methods & will not be held liable for any charges incurred by using any of these methods as Mastercard, Visa, Amex & banks may charge the consumer for using their facilities.
Refunds & returns
Banks, credit card companies & PayPal charge merchants a fee for using their facilities to process payments, a fee which is not refundable to the merchant in most cases.
If a consumer cancels an order, the payment has been made & the goods have not been shipped there is a 4% cancellation fee. This fee covers administration costs & merchant fees charged to Bay Park Photos by the financial institution/
If an order is cancelled & payment has not yet been processed (all credit card payments are processed manually) there is no cancellation fee. This does not apply to PayPal payments as they are automatic.
For orders that have been shipped & there is no fault with the product the item must be returned in resaleable condition & there is a 10% restocking fee on the total sale price. This fee covers the aforementioned merchant fees charged by the financial institution, administration fees & any freight costs incurred by Bay Park Photos where the freight costs by the transport company are higher than what Bay Park Photos has initially charged the consumer.
All freight costs for returns are to be borne by the consumer.
Any products claimed to be faulty will be checked by a qualified technician before a decision to refund, replace or repair is made. All liabilities are limited to those laid out under Australian Consumer Law.
All items are shipped with tracking & a signature will be required. If there is a problem with the item Bay Park Photos is to be notified within 3 week days of delivery.
When ordering online, IP addresses will be logged. If we suspect that an order is an attempted fraud your details will be reported to our bank and NSW police.
Your information will only be used to process your order. We will not reveal your personal information to any external organisation except where necessary for the purpose of filling your order (e.g. financial institutions that issued your credit card and courier companies that deliver your order).
